Basically, the US Dept of Transportation is basing their CAFE recommendations on a projected gasoline price of $2.04 to $3.37 per gallon through 2020. Mackey's bill requests that the CAFE decisions be based on a cost per gallon of gasoline that is not less than the estimated maximum cost to consumers.
From the bill "To amend title 49, United States Code, to require determination
of the maximum feasible fuel economy level achievable for cars and light trucks for a year based on a
projected fuel gasoline price that is not less than the applicable high gasoline price projection issued by the
Energy Information Administration."

In response to the National Highway Traffic Safety Administration, the part of the Department of Transportation (DOT) (responsible for implementing CAFE), released draft rule that projected gasoline will cost $2.04-$3.37 through 2020 (an average of about $2.60) and that hybrids would not be available until 2014. The DOT can only require fuel economy improvements if they pay for themselves through fuel savings. This has impact on the cost benefit analysis of improving mile per gallon requirements, the number of miles per gallon that new cars must supply.
Pickens Plan is awesome, but we also need fuel economy standards based on realistic gas prices. Please let your elected officials know you expect them to use realistic fuel prices for CAFE and fuel economy standards.
